Acceptance of Terms

These Terms of Service ("Terms") are a legally binding agreement between you ("you" or "User") and OakDev & AI AB, a Swedish limited liability company (org. nr. 559431-6787), headquartered at Kristevik 633, 451 96 Uddevalla, Sweden ("OakDev", "we", "us", or "our").

By downloading, installing, accessing, or using the Ayara mobile application or this website (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

These Terms apply in addition to any terms and conditions imposed by the Apple App Store or Google Play Store through which you download the app. In the event of a conflict, the more restrictive provision applies.

About Ayara

Ayara is a Shia Islamic spiritual guidance and reflection application developed and operated by OakDev & AI AB. The Service provides:

• Curated wisdoms and reflections drawn from the Qur'an, the Ahl al-Bayt (peace be upon them), Nahj al-Balagha, and classical Shia scholarship, organized across 15 thematic categories.
• An AI-assisted feature ("Ask Ayara Anything") that generates responses to your questions in the spirit of Shia Islamic tradition.
• Prayer time calculations based on your location, a monthly prayer calendar, and optional prayer notifications.
• A live Qibla compass and distance calculator.
• A digital dhikr counter.
• An in-app reflection system for accessing content.

Eligibility

Age Requirements

You must be at least 17 years of age (the minimum age required by the Apple App Store) or the minimum age required by applicable law in your country to use Ayara. In some jurisdictions this may be 13, 16, or 18. By using the Service, you represent that you meet the applicable age requirement.

If you are a parent or legal guardian who has permitted a minor to use the Service, you accept full responsibility for the minor's use of the Service and compliance with these Terms.

Geographic Availability

Ayara is available globally subject to applicable export control laws and regulations. We may restrict access to the Service from certain jurisdictions at any time. It is your responsibility to ensure that your use of the Service complies with local laws.

Capacity

By agreeing to these Terms, you represent that you have the legal capacity to enter into a binding contract. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Account Registration

Creating an Account

To access the full features of Ayara, you must create an account. You may register using an email address and password, or via a supported third-party sign-in provider (such as Apple Sign In or Google Sign In). By using a third-party sign-in, you authorize us to receive certain profile information from that provider as described in our Privacy Policy.

Account Accuracy

You agree to provide accurate, current, and complete information at registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Security

You must notify us immediately at hello@oakdev.app of any unauthorized access to or use of your account. We are not liable for any loss arising from unauthorized use of your account that occurs before you notify us, provided we have not been negligent.

One Account per Person

You may hold only one active Ayara account. Creating multiple accounts to exploit free reflections or bypass restrictions is prohibited and may result in termination of all associated accounts.

Account Deletion

You may delete your account at any time by following the instructions at /delete-account or by contacting us at hello@oakdev.app. Deletion is handled in accordance with our Privacy Policy.

Reflections System

What Are Reflections?

Reflections are Ayara's in-app token system. They are the means by which you access wisdom content and AI-powered features within the app. Reflections have no monetary value, cannot be transferred between accounts, are not redeemable for cash, and do not constitute a financial instrument or cryptocurrency.

Initial Reflections

Upon downloading the app and completing account registration, you receive 150 reflections at no charge. These initial reflections are provided as a welcome gift and are governed by these Terms.

Spending Reflections

Reflections are spent when you:

• Unlock a wisdom or reflection from any of the 15 available categories.
• Submit a question through the "Ask Ayara Anything" feature (one reflection per question).

Once a reflection is spent, it is consumed and cannot be recovered. There are no refunds for spent reflections.

Acquiring Additional Reflections

Additional reflections can be acquired through:

• Barakah Plan: A subscription that provides a monthly allotment of reflections in addition to other benefits.
• Top-Ups: One-time in-app purchases of reflection bundles.

Purchased reflections are subject to the payment terms in Section 7.

Expiration

Reflections that are purchased through a subscription (Barakah Plan) that you cancel do not roll over indefinitely — any unused subscription-cycle reflections expire at the end of the subscription period in which they were granted, unless otherwise stated in the subscription terms presented at purchase. Top-up reflections do not expire while your account remains active.

AI-Powered Features

Ask Ayara Anything

"Ask Ayara Anything" allows you to submit free-form questions and receive AI-generated responses informed by Shia Islamic tradition, classical scholarship, and the teachings of the Ahl al-Bayt (peace be upon them). Each question costs one reflection.

Nature of AI Responses

AI responses may occasionally be incomplete, inaccurate, or inconsistent. We continuously improve the system, but we make no warranty that responses are free from error. You agree to use AI responses with appropriate discernment and independent judgment.

Prohibited Questions

You may not use "Ask Ayara Anything" to:

• Request content that is defamatory, hateful, or inciting to violence.
• Solicit content that attacks, demeans, or misrepresents any Islamic tradition, community, or scholar.
• Attempt to extract harmful technical information.
• Deliberately probe or exploit the AI system in a way designed to produce outputs that violate these Terms.

Content Ownership

AI-generated responses are provided for your personal spiritual use. You may share brief excerpts for personal religious discussion but may not commercialize, republish, or represent AI-generated content as your own original work or as official religious guidance.

Data Processing

Questions submitted to "Ask Ayara Anything" are processed by our AI provider(s) as described in our Privacy Policy. Do not include personal information, such as names, addresses, or financial details, in your questions.

Subscriptions & Payments

Barakah Plan

The Barakah Plan is a recurring subscription that provides enhanced access to reflections and features. Subscription details — including price, billing interval, and reflection allotment — are displayed clearly in the app before purchase. By subscribing, you authorize OakDev (through the App Store or Play Store) to charge the applicable subscription fee at the beginning of each billing period.

Billing and Renewal

All purchases are processed through your Apple App Store or Google Play Store account. Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You can manage and cancel your subscription through your device's App Store or Play Store account settings.

Price Changes

We reserve the right to change subscription prices. We will notify you of any price change before it takes effect and give you the opportunity to cancel before being charged the new price. Your continued use of the subscription after the effective date of a price change constitutes your acceptance of the new price.

Taxes

Prices may or may not include applicable taxes (such as VAT). The App Store or Play Store will display the final price inclusive of any applicable taxes based on your billing address before you confirm a purchase.

Free Trials

We may offer free trial periods for the Barakah Plan. If you do not cancel before the end of the free trial, you will be automatically charged the subscription price. Detailed trial terms are presented at the time of the offer.

Refund Policy

App Store and Play Store Purchases

All in-app purchases, including subscriptions and reflection top-ups, are processed by Apple or Google through their respective stores. Refund requests must be submitted directly to the App Store or Play Store in accordance with their refund policies:

• Apple: Visit reportaproblem.apple.com or go to Settings → [Your Name] → Subscriptions in your Apple device.
• Google: Visit the Google Play Store → Profile → Payments & Subscriptions → Subscriptions.

OakDev Direct Refunds

We do not issue refunds directly for digital content that has been accessed or consumed. We may issue goodwill credits (in the form of reflections) at our sole discretion in response to verifiable technical errors that prevented you from accessing paid content. EU/EEA Statutory Rights

Intellectual Property

OakDev's Rights

All content, design, software, code, branding, trademarks, logos, text, graphics, images, audio, and other materials in the Service (collectively, "OakDev Content") are owned by or licensed to OakDev & AI AB and are protected by Swedish and international intellectual property laws.

Ayara®, the Ayara logo, and associated trademarks are the exclusive property of OakDev & AI AB. You may not use these marks without our prior written consent.

Your License

Subject to your compliance with these Terms, OakDev grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Ayara app on a device you own or control, solely for your personal, non-commercial use.

Restrictions

You may not:

• Copy, modify, distribute, sell, or sublicense any OakDev Content.
• Reverse engineer, decompile, or disassemble the app or any portion of it.
• Remove or alter any proprietary notices or labels.
• Use the Service to build a competing product or service.
• Frame or mirror any part of the Service without prior written consent.

Islamic Texts and Quotations

Qur'anic verses, hadith, and other classical Islamic texts that appear in the Service are drawn from the public domain or are used under applicable license. We respect the sacred nature of these texts and have taken care in their presentation. Any translation choices made within the app are editorial and do not constitute a definitive or authoritative translation.

User Content

What Is User Content

User Content refers to any text, information, or data that you submit to the Service, including questions submitted to "Ask Ayara Anything," feedback submitted through support channels, and any other content you provide.

License Grant

By submitting User Content, you grant OakDev a worldwide, royalty-free, non-exclusive license to use, store, reproduce, and process your User Content solely for the purpose of providing, maintaining, and improving the Service. This license does not grant OakDev the right to sell your User Content to third parties or use it for marketing purposes without your separate consent.

Your Responsibility

You are solely responsible for your User Content. You represent that you have all rights necessary to grant the above license and that your User Content does not violate any law or third-party rights.

Prohibited Content

User Content must not be:

• False, misleading, or deceptive.
• Defamatory, obscene, hateful, discriminatory, or harassing.
• In violation of any intellectual property rights.
• Blasphemous, disrespectful of the Qur'an or the Ahl al-Bayt, or designed to mock or demean Islamic faith.
• Containing personal data of third parties without their consent.

Prohibited Conduct

You agree that you will not, in connection with the Service:

• Violate any applicable law, regulation, or these Terms.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
• Attempt to gain unauthorized access to any portion of the Service or any related system.
• Interfere with or disrupt the integrity or performance of the Service or its servers.
• Introduce any malware, viruses, or other harmful code.
• Use automated means (bots, scrapers) to access the Service in a way that places an unreasonable load on our infrastructure.
• Circumvent, disable, or otherwise interfere with security-related features of the Service.
• Use the Service to spread religious extremism, incite sectarian hatred, or promote violence.
• Exploit, harm, or attempt to exploit or harm minors in any way.
• Use the Service for any commercial purpose without our written authorization.

Violations of these prohibitions may result in immediate account suspension or termination and, where appropriate, referral to law enforcement.

Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, store, and share information about you. Please read it carefully.

Key privacy commitments relevant to your use:

• Your precise location for Qibla and prayer times is processed on your device and never transmitted to our servers.
• We do not display advertising in the Service.
• You may request deletion of your data at any time. See /delete-account.

Push Notifications

Ayara may send push notifications to your device for prayer time reminders and other spiritual prompts, subject to your device permissions. You can enable or disable push notifications at any time through your device's system settings or within the app.

Push notifications are sent based on locally calculated prayer times for your approximate location. No notification content is used to identify you or track your activity. Disabling push notifications does not affect your access to any features of the Service.

Third-Party Services

App Stores

Ayara is distributed through the Apple App Store and Google Play Store. Your use of those stores is governed by Apple's and Google's respective terms of service. OakDev is the developer of Ayara; Apple and Google are not parties to these Terms and are not responsible for the Service.

Apple-Specific Terms

If you download Ayara from the Apple App Store, you acknowledge that:

• These Terms are concluded between you and OakDev, not Apple.
• Apple has no obligation to furnish any maintenance or support services for Ayara.
• In the event of any failure of Ayara to conform to applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to Ayara.
• Apple is not responsible for addressing any claims by you or any third party relating to the Service.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.

Third-Party Links

The Service may contain links to third-party websites or services. These links are provided for convenience only. OakDev does not endorse, control, or assume responsibility for the content, privacy practices, or availability of third-party websites. You access third-party services at your own risk.

AI Providers

Our AI features are powered by third-party large language model providers who process your questions under data processing agreements in accordance with our Privacy Policy. We select providers with strong privacy and security standards.

Disclaimers

Service Provided "As Is"

To the maximum extent permitted by applicable law, the Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. OakDev expressly disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

No Religious Authority

Accuracy of Content

While we strive to present accurate and authentic Shia Islamic content, we do not warrant that the Service is free from errors, inaccuracies, or omissions. Translations of classical Arabic texts involve scholarly judgment and may differ from other available translations.

Service Availability

We do not guarantee that the Service will be available at all times, uninterrupted, or error-free. We may suspend or discontinue the Service at any time, including for maintenance, improvements, or business reasons, with or without prior notice.

Prayer Time Accuracy

Prayer times calculated by Ayara are based on standard astronomical calculation methods. Local mosque times may differ. You should verify prayer times with your local Islamic authority, especially during Ramadan, Eid, and other significant religious occasions.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event will OakDev & AI AB, its directors, officers, employees, agents, licensors, or service providers be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, business, or goodwill.
• Damages resulting from your reliance on AI-generated content for religious, legal, medical, or financial decisions.
• Damages resulting from unauthorized access to or alteration of your transmissions or data.
• Any matter beyond our reasonable control.

To the extent OakDev's liability is not otherwise excluded, our total liability to you for any claims arising from or related to the Service shall not exceed the greater of:

• The total amount you paid to OakDev in the twelve (12) months before the claim arose; or
• EUR 50.

Termination

Termination by You

You may stop using the Service at any time by deleting your account (see /delete-account). If you have an active Barakah Plan subscription, cancellation of the subscription is handled through the App Store or Play Store; deleting your account does not automatically cancel your subscription.

Termination by OakDev

We may suspend or permanently terminate your access to the Service, with or without notice, if we determine in our reasonable judgment that you have:

• Violated any provision of these Terms.
• Engaged in conduct harmful to other users, third parties, or OakDev.
• Created multiple accounts to abuse the free reflection allotment.
• Attempted to circumvent security measures or technical limitations.

Effect of Termination

Upon termination, all licenses and rights granted to you under these Terms immediately cease. Any outstanding payment obligations survive termination. Unused reflections in a terminated account are forfeited without compensation. Sections 9, 10, 15, 16, and 18 survive termination of these Terms.

Account Deletion

Following termination or voluntary deletion, we will handle your personal data in accordance with our Privacy Policy. You may submit a data deletion request at any time.

Governing Law & Disputes

Governing Law

These Terms are governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

Dispute Resolution

We encourage you to contact us first at hello@oakdev.app to resolve any dispute informally. We will make reasonable efforts to resolve any complaint within 30 days.

If informal resolution fails, any dispute, controversy, or claim arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Sweden, with the District Court of Gothenburg (Göteborgs tingsrätt) as first instance, unless mandatory consumer law in your country of residence grants you the right to bring proceedings in your local courts.

EU Online Dispute Resolution

If you are a consumer in the EU/EEA, you may also use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. Our email for ODR purposes is hello@oakdev.app.

Swedish Consumer Rights

Nothing in these Terms affects your rights as a consumer under Swedish law, including the right to file a complaint with the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN) at arn.se.

Changes to Terms

We may update these Terms at any time. When we make material changes, we will notify you by:

• Displaying a notice within the Ayara app.
• Sending a notification to the email address associated with your account (where applicable).
• Updating the "Last updated" date at the top of this page.

Changes are effective when posted. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those Terms. If you do not agree to the updated Terms, you must stop using the Service and, if applicable, cancel your subscription.

We will not apply changes retroactively in a way that materially diminishes your accrued rights without providing prior notice and a reasonable opportunity to respond.
